As of July 1, 2021, the Design and Building Practitioners Act 2020 (NSW) came into effect, introducing compliance requirements for Class 2 buildings. These regulations have since been expanded in July 2023 to also include Class 3 and 9c buildings, such as boarding houses, hostels, and aged care facilities.

Under the Act, designers, builders, and engineers must now provide compliance declarations before undertaking work on these structures. This ensures that designs comply with the Building Code of Australia (BCA) and relevant Australian Standards. All regulated designs must be documented and lodged before construction begins, preventing costly rework and safety risks.

REGULATED DESIGNS AND DECLARATIONS

Regulated Designs refer to critical building components that require compliance certification before construction begins. Only registered design practitioners, such as remedial engineers, can provide these certified designs. Compliance Declarations ensure accountability throughout the construction process. These include:

Design Compliance Declaration:
Confirms a regulated design meets the BCA requirements.

Building Compliance Declaration:
Certifies that construction aligns with an approved regulated design.

Principal Compliance Declaration:
Confirms that all required compliance declarations have been completed by registered practitioners.

Failure to comply with these requirements can result in severe penalties, including fines of up to $165,000 for corporations and $55,000 for individuals, as well as possible criminal charges.
